These Terms of Service (“Terms”) govern your access to and use of the LagoonIQ water-testing software and website (the “Service”), provided by LagoonIQ, LLC (“LagoonIQ,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
LagoonIQ lets pool and spa stores record water-test results, generate chemical dosing recommendations, print or export results, and track history over time. Dosing recommendations are estimates for informational purposes only and are not a substitute for professional judgment. You are responsible for verifying chemical amounts against product labels and your own procedures before dosing any pool or spa.
2. Safety and chemical handling
Pool and spa chemicals are hazardous and can cause serious injury, illness, death, or damage to property and equipment if mishandled. All readings, dosing amounts, water-balance figures, and other output of the Service are suggestions and estimates only. They are not professional, medical, or safety advice, and they cannot account for every condition of your specific water, equipment, or chemicals. You must exercise your own judgment and caution: follow all manufacturer label directions and safety data sheets, never mix chemicals together, always add chemicals to water (never water to chemicals), use appropriate protective equipment, keep chemicals away from children and pets, and consult a licensed pool professional whenever you are unsure. You assume all risk arising from handling chemicals and from relying on any recommendation, and you agree that LagoonIQ is not responsible for how recommendations are applied.
3. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old and authorized to bind your business to these Terms.
4. Subscriptions, trials, and billing
LagoonIQ is offered on a paid subscription basis with a free trial period. When your trial ends, your payment method is charged the then-current subscription fee on a recurring basis until you cancel. Payments are processed by our third-party processor, Stripe; we do not store your full card details. Fees are billed in advance and are non-refundable except where required by law. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable advance notice.
5. Acceptable use
You agree not to misuse the Service, including by attempting to access it without authorization, interfering with its operation, reverse-engineering it, reselling it, or using it to store unlawful content or violate the rights of others.
6. Your data
You retain ownership of the customer, address, and test data you enter (“Your Data”). You grant us a limited license to host and process Your Data solely to provide and improve the Service. You are responsible for having the right to provide any personal information about your customers, and for handling it in line with applicable law. Our handling of personal data is described in our Privacy Policy.
7. Intellectual property
The Service, including its software, design, and content, is owned by LagoonIQ and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
8. Third-party services
The Service relies on third-party providers (including for payments, hosting, database, and email delivery). Your use of the Service may be subject to their terms, and we are not responsible for their acts or omissions.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that dosing recommendations will achieve any particular result.
10. Limitation of liability
To the maximum extent permitted by law, LagoonIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim. Without limiting the foregoing, LagoonIQ is not liable for any personal injury, illness, death, or property or equipment damage arising from your handling of chemicals or your reliance on any reading, dosing recommendation, or other output of the Service; responsibility for safe chemical handling and for the results of any dosing rests with you.
11. Indemnification
You agree to indemnify and hold LagoonIQ harmless from claims arising out of Your Data, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or fail to pay. Upon termination, your right to use the Service ends; we may delete Your Data after a reasonable period.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, and the state and federal courts located there will have exclusive jurisdiction over any disputes.
